CursedPic — Terms of Use

1. What CursedPic is

CursedPic is a small browser party game hosted at cursedpic.com. You and your friends type short text prompts for different parts of a character and an AI image model generates a single combined image for your group.

The service is operated from Malta and is currently an experimental side project. It is provided for entertainment only.

2. Age and eligibility

CursedPic is intended only for people who are at least 18 years old. By using the site, you confirm that you are 18 or older.

This age limit is required because CursedPic uses third party AI services, including the Google Gemini API, whose terms state that the APIs are only for users who are 18+ and must not be used in apps directed towards or likely to be accessed by individuals under 18.

If you are under 18, please do not use CursedPic, or only do so under parental supervision.

3. How the game works

When you create or join a session, CursedPic:

  • Stores the text prompts you and your friends type into the prompt boxes.
  • Sends those prompts (plus internal safety instructions) to a third party AI image generator such as Google Gemini.
  • Receives the generated image and shows it to the people in the session.

The final image may differ from what you expect. AI models can be unpredictable, may misinterpret prompts, and sometimes refuse to generate an image at all.

4. User content and acceptable use

Anything you type into CursedPic, including prompts, nicknames, and session names, is considered “User Content”. You are responsible for that content.

When using CursedPic, you agree that you will not submit content that:

  • Is illegal or promotes illegal activity.
  • Is hateful, harassing, or targets people based on protected characteristics.
  • Is sexually explicit or involves nudity, especially any content involving minors.
  • Contains graphic or extreme violence or gore.
  • Involves real, identifiable people (such as celebrities or private individuals) in a way that could violate their rights.
  • Infringes someone else’s intellectual property rights, including logos and brand names.
  • Attempts to bypass or defeat any AI safety or content filters.

You also agree not to interfere with the service, attempt to break its security, or spam the system with automated requests.

5. AI safety and prompt rewriting

To keep the game safe and to comply with the limitations and policies of the image generation models we use, CursedPic may automatically rewrite or adjust your prompts before sending them to the AI.

For example, CursedPic may:

  • Remove or soften illegal, hateful, sexual, or extremely violent details.
  • Replace references to real people or brands with fictional alternatives.
  • Modify wording so the AI model is less likely to refuse the request.

By using CursedPic, you agree that your prompts may be rewritten in this way and that the final image may not literally match every word you typed.

6. Blocking and content removal

CursedPic may remove content or restrict access to the service at any time if there is suspected abuse, spam, or a breach of these terms or of the safety requirements of the underlying AI models.

This may include blocking particular sessions, IP addresses, or other technical identifiers to protect the service and other users.

7. Ownership and licence to use your content

Different countries treat AI-generated images differently under copyright law, and some may not recognise copyright protection for purely AI-created works. To keep things simple and to let CursedPic actually run as a shared party game, this section explains how prompts and images can be used.

You keep whatever rights you have (if any) in the prompts and images you create when using CursedPic, but by submitting any content to the service you grant CursedPic a worldwide, non-exclusive, perpetual, irrevocable, royalty-free licence to:

  • host, store, copy, display, and otherwise process your prompts and generated images,
  • modify and adapt them (for example by cropping, adding captions or logos, or combining them into collections),
  • publish and share them in any media, including public galleries on cursedpic.com, social media posts, marketing materials, and demo content,
  • use them for commercial purposes, including physical or digital prints, merchandise, or other products, and
  • sub-license or otherwise allow others to view, share, remix, and reuse those images on a similar basis.

You agree that the content you submit is non-confidential and may be made publicly available by CursedPic. You should not include real personal data or anything you would not be comfortable seeing shared more widely.

You confirm that you will not submit prompts or content that violate other people’s rights, including copyright, trademarks, or rights of publicity (for example, realistic depictions of identifiable real people or logos), and you understand that CursedPic may refuse, adjust, or remove such content.

Nothing in this section limits any rights that the providers of the underlying AI models may have under their own terms, but CursedPic does not claim ownership of your prompts or outputs beyond the licence described above.

8. Ads and third party services

CursedPic relies on third party services such as hosting providers, AI model providers, and advertising networks. In particular, the site uses or may use Google products including:

  • Google Gemini, to generate images from text prompts.
  • Google AdSense, to show banner ads and possibly rewarded ads while you wait for images to generate.
  • Analytics tools in the future, to understand overall usage patterns.

These providers process data under their own terms and privacy policies. CursedPic does not control which specific ads you see.

Remember that ads and AI services may place cookies or similar technologies in your browser. Those are covered by the providers’ own policies.

9. Payments

At the moment, all rounds on CursedPic are free. There is no paid subscription and no option to pay to remove ads.

If CursedPic introduces paid options in the future, these terms will be updated to explain how payments and refunds work before any paid feature goes live.

10. Data, storage, and deletion

CursedPic is not designed as a permanent storage service for your prompts or images. Sessions, prompts, and generated images may be deleted at any time, for example to free up storage space or when cleaning up old data.

There is no guarantee that any particular image or game session will stay available for a specific length of time.

11. No warranty

CursedPic is provided on an “as is” and “as available” basis. To the maximum extent allowed by law, there are no guarantees about uptime, performance, or the quality or safety of AI generated content.

You should not rely on CursedPic for anything important, professional, or sensitive. It is just a silly party game.

12. Limitation of liability

To the maximum extent permitted by applicable law, CursedPic will not be liable for any indirect, incidental, or consequential damages, or for any loss of data or opportunity, arising out of or in connection with your use of the service.

Nothing in these terms is intended to exclude or limit any rights you have under mandatory law.

13. Changes to these terms

CursedPic may update these terms from time to time. When this happens, the “Last updated” date at the top will change. If you continue to use the site after the update, that means you accept the new terms.

14. Governing law

These terms are governed by the laws of Malta. Any disputes relating to these terms or to CursedPic can be brought before the courts of Malta, without affecting any mandatory rights you may have under the laws of your own country.

15. Contact

At this stage CursedPic does not publish a dedicated support or privacy email address. If a contact channel is added in the future, it will be shown clearly on the site, and that will be the way to reach the project about these terms.
